O alta problema abordata in cadrul dezbaterilor privind finantarea venitului de solidaritate activa (RSA) vizeaza faptul ca scutul fiscal nu ia in considerare venitul real, ci venitul fiscal de referinta. Or, acesta poate fi redus cu mai multe sute de milioane de euro prin utilizarea dispozitivelor fiscale derogatorii (deficite funciare, industriale si comerciale) si a niselor neplafonate (dispozitiv Malraux, monumente istorice, legea Robien).
