Le bénéficiaire s’engage, en cas de licenciement par le prestataire d’un (ou plusieurs) de ses anciens salariés, à participer au paiement de l’indemnité de licenciement qui pourrait être due, au prorata de l’ancienneté acquise par ce salarié au sein de XXX à la date du transfert de l’activité.
Cette participation ne sera pas due en cas :
- de rupture du contrat de travail dans le cadre d’une rupture conventionnelle.
Le prestataire devra rembourser cette participation au bénéficiaire si au terme d’un contentieux prud’homal engagé par le salarié licencié, il devait être jugé que le licenciement ne repose pas sur une cause réelle et sérieuse.
