La donation residuelle bénéficie à deux donataires. Le bien est donné à un premier bénéficiaire, le second ne recevant que ce dont le premier n'a pas disposé de son vivant.
L’acte authentique prévoit deux bénéficiaires pour une même donation. Mais ils en bénéficient l’un après l’autre.
La donation est consentie à un premier bénéficiaire. Il peut faire ce qu’il veut du bien reçu. Sa seule obligation est de transmettre ce qu’il reste du bien à son décès. Il peut donc vendre le bien, le transformer mais n’a pas le droit de le transmettre gratuitement (c’est-à-dire par testament).
L’intérêt de la donation residuelle est de conserver un bien dans la famille, tout en permettant au premier bénéficiaire d'en profiter. |
