Law/Patents - Law (general) | | German term or phrase: Vollstreckungsstandschaft | Uit een commentaar van een Duitse advocaat op een arrest van het HvJ EU inzake de tenuitvoerlegging van een geldboete door een private schuldeiser:
[...] dass das Urteil des EuGH nichts an der Forderungszuständigkeit hinsichtlich des Ordnungsgeldes ändert. Diese verbleibt ausschließlich beim Staat. Der private Gläubiger handelt insoweit im Rahmen der EU-Auslandsvollstreckung lediglich kraft einer Vollstreckungsstandschaft (näher hierzu Giebel, IPRax 2009, 324 [326 f.]). Er bleibt daher unverändert verpflichtet, den Erlös der Ordnungsgeldvollstreckung im EU-Ausland an die Justizkasse des jeweiligen Bundeslandes abzuführen.
