Jedoch sieht er diese Möglichkeit als eine Art *Maximallösung* und sie erscheint ihm demnach nicht erforderlich. Seine Ablehnung begründet er aus dem Standpunkt heraus, dass es im Gläubigerschutz vordergründig auf die Ermittlung eines ausschüttungsfähigen Gewinns und eines vorsichtig berechneten Reinvermögens ankommt.

IMO, the literal translation of Maximal- > maximum doesn't work here. Furthermore, the 'ultimate solution' may in fact be a trimmed-down solution. |
