Most states of the EU have now transposed the Directive into national law, even though some – such as France, Spain and Portugal – have done so with reluctance and various restrictions. In Germany, however, the Directive has yet to be transposed, despite the fact that the Federal Government submitted a draft law to this end last year which is currently under review in the Bundestag and Bundesrat, the lower and upper houses respectively. The biopatent debate in Germany is particularly controversial, even within the red-green coalition government.
Die meisten EU-Staaten haben die Richtlinie inzwischen in nationales Recht umgesetzt, wenn auch teilweise – wie Frankreich, Spanien und Portugal – nur widerstrebend und mit Einschränkungen. In Deutschland dagegen ist die Richtlinie noch immer nicht umgesetzt. Zwar hat die Bundesregierung im vergangenen Jahr dazu einen Gesetzesentwurf vorgelegt, der derzeit in Bundestag und Bundesrat beraten wird. Doch der Streit um die Biopatente wird hier zu Lande besonders heftig geführt – bis hinein in die rot-grüne Bundesregierung.
