I think this means "applicability" or something like that, but I have found no
dictionary that uses the word this way. The only source I have for this translation is http://www.proz.com/kudoz/german_to_english/law:_taxation_cu... -- there it is a verb. I want to verify that this makes sense in my context, as a noun.
It pertains to the law governing "Sachmangel," or Material Defects.

Das Erfordernis des "Durchschlagens" und seine Konkretisierung

Zum neuen Recht wird die Ansicht vertreten, dass es auf die Voraussetzung des
"Durchschlagens" nicht mehr ankomme und also alle Mängel einzelner Sachen stets
zur (entsprechenden) Anwendung von § 434 BGB fuhren.

Thanks Johanna, that makes sense-was curious about the use of the word and why its used here rather than Wirkung etc. etc. - I guess cos its not just any old Wirkung but a "durchschlagende Wirkung" as you say! And the idea of applicability - so, for instance, if the impact/effect/repercussions of one faulty unit is/are applicable to the entire Unternehmen... (then U. is liable ..?)

agree  Johanna Timm, PhD: yes, as in the other sources quoted above: "durchschlagend" is the effect on the "whole"/entire(gesamtes U.) as opposed to the effect of individual (einzelne)faulty units
