German term or phrase: Verwendung vs Nutzung
Good morning,

apart from the fact that I am battling with the "unbefugter Kenntnisnahme durch Dritte" I am a bit baffled as to the difference between "Verwendung" and "Nutzung". Do I actually have to differentiate between them, convulting the sentence by using "use" or "utilization" with "employment"?

So far have:

The Covenantor shall treat all information as confidential and take any necessary measures to safeguard such information against misuse, becoming known to unauthorized persons, copying, use, unauthorized access and unauthorized utilization.

Seems a bit "doppelt-gemoppelt" to me. Any ideas?

Explanation:
I agree with you that this a case of "doppelt gemoppelt" (or an "artificial distinction"), and can't think of anything else than "use" in this context. "Unauthorised use" is a "classic" in such provisions.

-> This could be translated as follows:
The Covenantor [person/entity bound by this agreement] [Obligor?] will treat any and all information (strictly) confidential, and take any necessary measures to safeguard such information against any misuse, unauthorised disclosure to third parties, reproduction [copying], or unauthorised access and use.

Further questions:
What type of agreement is this about, and who are the parties thereto? Who exactly is the "Verpflichtete"?
(This might be important re. the correct translation of "Verpflichteter".)

Thank you very much Steffen. Have opted for "the Undersigned" for "Verpflichteter" after long deliberation and your "use".

agree  David Williams: Not too sure about "Covenantor". How about "The party to this agreement" or "The Principal"?

-> I see no indication of "principal" in Natalie's context (I've simply taken over "Covenantor" from her initial suggestion for want of a better term). "Party to this agreement" might be a neutral way out here, though.

agree  Armorel Young: I even wonder if the writer meant to say "Verwertung", as Verwendung adds little when we already have Missbrauch and unerlaubte Nutzung

-> Yes, VERY good thinking - this would be equivalent to "exploitation".
