Good morning,

apart from the fact that I am battling with the "unbefugter Kenntnisnahme durch Dritte" I am a bit baffled as to the difference between "Verwendung" and "Nutzung". Do I actually have to differentiate between them, convulting the sentence by using "use" or "utilization" with "employment"?

Der Ver¬pflichtete wird sämtliche Informationen geheimhalten und alle erforderlichen Ma߬nahmen treffen, damit ihm bekannt gewordene Informationen vor Missbrauch, un¬befugter Kenntnisnahme durch Dritte, Vervielfältigung, Verwendung, unberech¬tig¬tem Zugriff und unerlaubter Nutzung geschützt sind.

Seems a bit "doppelt-gemoppelt" to me. Any ideas?

I agree with you that this a case of "doppelt gemoppelt" (or an "artificial distinction"), and can't think of anything else than "use" in this context. "Unauthorised use" is a "classic" in such provisions.

The Covenantor [person/entity bound by this agreement] [Obligor?] will treat any and all information (strictly) confidential, and take any necessary measures to safeguard such information against any misuse, unauthorised disclosure to third parties, reproduction [copying], or unauthorised access and use.

agree  David Williams: Not too sure about "Covenantor". How about "The party to this agreement" or "The Principal"?

  -> I see no indication of "principal" in Natalie's context (I've simply taken over "Covenantor" from her initial suggestion for want of a better term). "Party to this agreement" might be a neutral way out here, though.
