actually need help with the whole sentence:
Diese Einwilligung gilt nur, wenn der Versicherungsnehmer die Moeglichkeit hatte, in zumutbarer Weise vom Ihnalt des vom Versicherer bereitgehaltenen Merkblattes zur Datenverarbeitung Kenntnis zu nehmen.

How's this sound?:
This consent is only applicable if the insured had reasonable opportunity to review the contents of the data processing technical information sheets held by the insurer.

A "Merkblatt zur Datenverarbeitung" explains in which ways data collected from the user (in this case: from the insured person) is stored and processed electronically. (100% about that one)

So essentially this sentence is about data protection guidelines: In the "Einwilligung", the insured gives his consent to his data being stored and processed electronically, but his consent is only legally binding, if he has been told (by virtue of being handed the "Merkblatt zur Datenverarbeitung") HOW exactly his data is going to be used.

Not sure, though, how you would call such a leaflet in English. "data protection policy" is just a guess.

For legal reasons, you should of course use exactly the same term that is printed as headline on this very leaflet. Ask the client if the leaflet is not part of your translation job as well.

Why *technical* information sheets? I don't see any indication of the Merkblätter containing technical information. Info-sheet could work.
