Sollten die mit dem Kredit finanzierten Anschaffungs- oder Herstellungskosten des Wirtschaftsgutes den der Bank aufgrund der Abtretung zustehenden Betrag unterschreiten, wird der Sicherungsgeber dies der Bank mitteilen. Die Bank wird auf Verlangen von den ihr abgetretenen Ansprüchen den zuletzt zu zahlenden Teilbetrag in Hoehe dieses Differenzbetrages an den Sicherungsgeber zurückabtreten, wenn der Kredit über die nachgewiesenen Anschaffungs-/Herstellungskosten hinaus noch nicht in Anspruch genommen worden ist.

agree Derek Gill Franßen: Yes, seeing as how the context isn't in a court of law - then I would have expected "substantiiert vorgetragene", which could also mean "to plead in a detailed manner" (or so). In a court "nachgewiesen" would mean "proven" (IMO).

disagree Terry Moran: Not wrong, just not the most normal term. Response to comment: because although both proven and evidenced are often perfectly good translations of nachgewiesen, they're not as good as documented here. If they're not right, I disagree with them!

  -> Although "documented" is very good, I beg to differ at least for "proven" here, which I see as equally appropriate ("evidenced" might be somewhat less usual, though). Q: Why do you actually disagree if the term's "not wrong" acc. to your own statement?
