The term "Enthaftungsabrede" refers to a provision which "Ihnen im Schadenfall erlaubt zu entscheiden, ob Sie im konkreten Fall Ihre allgemeinen Geschäftsbedingungen durchsetzen oder [...] nach üblichen Gesetzesgrundlagen entschädigen wollen".

Is anyone familiar with an English term for a clause of this kind?
