This (again) is from an auditor's report for a KAG. Marktgerechtigkeit (market conformity) comes up quite often, and I can't seem to locate the exact wording in English of the regulation it is referring to. English language texts in this regard seem to suggest that we need to talk about "orderly transactions", but the double negative in the first one and the "verschachtelung" in the second one are killing me ...

Geschäfte zu nicht marktgerechten Konditionen haben auskunftsgemäß nicht stattgefunden

According to the disclosures made to us, there were no transactions made that were not orderly.

Nach § 5 DerivateV ist für Geschäfte, bei denen Interessenskonflikte nicht auszuschließen sind, durch angemessene Kontrollverfahren sicherzustellen, dass diese zu marktgerechten Konditionen abge-schlossen werden.

In accordance with section 5 DerivateV, companies must institute appropriate control procedures to ensure that any transactions that may present a conflict of interest are orderly transactions.

"Marktgerecht" is the same as "marktüblich" here.

Asker: I think this sounds right, Steffen. In the context of conflict of interest this does seem to be the right term. I was hoping there was a specific paragraph of some law that it refers to that would have a standard translation. As I mentioned, it comes up in other contexts as well - maybe "orderly transactions" is a good general phrase for other contexts.
