In the clause of a set of AGBs dealing with the supplier's liabilities under warranty obligations.

Sämtliche Schadensersatzansprüche gegen uns, gleich aus welchem Rechtsgrund, verjähren spätestens in einem Jahr seit Ablieferung der Sache an den Kunden oder Erbringung der Leistung, im Fall der deliktischen Haftung ab Kenntnis oder grob fahrlässiger Unkenntnis von den den Anspruch begründenden Umständen und der Person des Ersatzpflichtigen.

Nick Somers: 5:16am Oct 14, 2005: I humbly bow to my superiors on this issue, but for everyone's information I should just like to quote from A Modern Dictionary of Legal Usage: "Knowledge requires awareness of a fact ... while notice requires merely a reason to know of a fact ..." -
Margaret Marks: 8:22am Oct 14, 2005: Nick, I'm sure you don't humbly bow to anyone, but Kenntnis means both. In law, Kenntnis and notice are the terms used. Hence tatsächliche Kenntnis = actual notice, zurechenbare Kenntnis = constructive notice. -
Kieran McCann: 8:13am Oct 15, 2005: I'm no expert here, but if 'Kenntnis' is notice, what is 'Unkenntnis' and how will the symmetry of the German phrasing be retained? -
