f) Der AN hat eine entsprechend § 348 HGB nicht herabsetzbare verschuldensunabhängige Vertragsstrafe von € [___] für jede ausgetauschte in Anlage [2.3] angeführte Person zu bezahlen, es sei denn, der Austausch erfolgt aufgrund von Tod, nachgewiesener Erkrankung, Eigenkündigung der ausgetauschten Person, gerechtfertigter Entlassung durch den AN, Verlangen des AG oder im Einvernehmen zwischen dem AG und AN. Eines Vorbehaltes der Vertragsstrafe bedarf es nicht.

I understand the concept of strict liability, but am trying to figure out what it means to reserve a contractual penalty. What exactly is meant by reservation in this context?
