I agree with the first portion of Kim's suggestion. The German portion "... als solche Garantie...", however, would translate into: "such a guarantee" (the German translation of "a guarantee as such" would be "eine Garantie als solche").

I suggest to translate:
"... sofern nicht ausdruecklich etwas anderes bestimmt ist" as "unless expressly provided otherwise." This is standard legal language.
