Während man bislang davon ausging, dass der Bestand einer Betriebsstätte einer gewissen örtlichen, zeitlichen und organisatorischen *Verfestigung* des Unternehmens im Ausland bedarf, ist das nach aktueller, von der OECD zum Ausdruck gebrachter Rechtsansicht, nicht mehr nötig. Ein Büro, vom Auftraggeber zur Verfügung gestellte Räume oder sonstige „feste Einrichtungen“ sollen nicht mehr erforderlich sein.
