Das Finanzgericht Hamburg hat in seinem Beschluss vom 4. April 2011 verfassungsrechtliche Zweifel an dem Untergang steuerlicher Verlustvorträge aufgrund eines schädlichen Beteiligungserwerbs geäußert und eine entsprechende **Prüfungsvorlage** an das Bundesverfassungsgericht gerichtet.

I think the Finanzgericht has submitted a legal test or formula.

Nach dem inzwischen verfestigten Prüfungsmuster, welches auf drei Kriterien abstellte, nämlich auf Ausdehnung des Straftatbestands, auf grobe Verfahrensmängel oder auf ein unerträgliches Mißverhältnis zwischen Schuld und Strafe, kam das Gericht zum folgenden Ergebnis.

In Zuckerfabrik Schoeppenstedt the Court formulated the “Schoeppenstedt formula” according to which there is no liability of the Community “unless a sufficiently flagrant violation of a superior rule of law for the protection of the individual has occurred”. The Court has applied this formula in later cases and as it is not easy to meet the test, the action has been successful in very few cases. It seems that the Court has followed a very restrictive approach in the access of non-privileged applicants to the action for annulment and to the action for damages.

When I entered 'Prüfungsvorlage' in Google under eur lex, I kept coming up with 'Prüfungsmuster'. I don't know if the official translation is of much help.
