German to English translations [PRO]
Law/Patents - Law (general) / Collateral Agreement
German term or phrase: Duldungstitel
This is in the overall context of a loan agreement. The borrower is pledging its interests in a Limited Partnership as collateral to secure the loan. I am looking specifically for a translation for "Duldungstitel":

"Sofern der Gesellschaftsvertrag dies zulässt, ist das Kreditinstitut berechtigt, falls seine durch das Pfandrecht gesicherten Forderungen nicht innerhalf eines Monats nach Eintritt der jeweiligen Fälligkeit befriedigt werden, die verpfändeten Beteiligungen ohne Duldungstitel ... an jedem ihr zweckmäßig erscheinenden Ort versteigern zu lassen ..."

Thank you in advance for your help.

neutral  Derek Gill Franßen: Yes and no (I would say), because it seems to me that it is not only a writ (=formal written order) of execution, but a particular form thereof. My two cents... BTW - Hope you are well, Kim. :)
