Der gerichtliche Erlag befreie nicht The court deposit does not release (the debtor from liability) Explanation: Befreien - to release - needs an object, which will be the person who paid it in. The debtor pays the money into court because he/she does not know which of several persons claiming the payment (the Prätendenten - the pretenders!) ought to have it. But if the debtor, on reviewing the situation to a degree that can reasonably be expected of him, could easily have seen who the money should be paid to, he can't get off the hook by paying the money into court. |
