Das Erstgericht fuehte auf Seite 12 des angefochtenen Beschlusses weiters aus, dass als wichtiger Grund fuer die Vornahme der gerichtlichen Hinterlegung auch das Vorhandsein mehrerer Forderungs-praetendenten anzusehen sei. Nach 1425 ABGB koenne sich nur derjenige auf Unklarheit berufen, wem die Pruefung der Sach- und/oder Rechtslage unzumutbar sei. Der gerichtliche Erlag befreie nicht, wenn der Schulder bei zumutbarer Pruefung die Lage leicht erkennen koenne. Entscheidend fuer das Hinterlegungsrecht sei, dass der Schulner bei zumutbarer Pruefung die wahre sach - und/oder Rechtslage nich (ohne weiteres) erkennen koenne.

The text comes from Austria and concerns a first-instance judicial decision regarding bailment law. It seems a debtor has decided to deposit funds with the Court for some reason (not sure why?).

I am struggling with "Der gerichtliche Erlag befreie nicht". I think it might be "the deposit with the Court is not released" but am not at all sure....any assistance appreciated, many thanks in advance:0).

Explanation:
Befreien - to release - needs an object, which will be the person who paid it in. The debtor pays the money into court because he/she does not know which of several persons claiming the payment (the Prätendenten - the pretenders!) ought to have it. But if the debtor, on reviewing the situation to a degree that can reasonably be expected of him, could easily have seen who the money should be paid to, he can't get off the hook by paying the money into court.
