neutral  Kim Metzger: Expertise is a false friend. A Gutachten (Expertise in Swiss German) is an expert opinion. The English term "expertise" means "know-how."

Das Kantonsgericht des Kantons Zug kann auf Antrag einer Partei Verfügungen treffen, die dazu dienen, gefährdete Beweise sicherzustellen. Will z.B. jemand bauen (Neubau, Umbau etc.), und können diese Bauarbeiten schädigende Auswirkungen auf die Nachbarliegenschaften haben, so kann der Bauherr den Zustand der Nachbarliegenschaften vor Baubeginn durch eine Expertise feststellen lassen. Auf diese Weise kann festgehalten werden, welche Schäden bereits vor Beginn der Bauarbeiten bestanden haben und daher mit Sicherheit nicht durch diese verursacht worden sind. Der Bauherr kann sich mittels einer so genanten vorsorglichen Beweisaufnahme gegen ungerechtfertigte Forderungen der Nachbarn absichern.

agree  Johanna Timm, PhD: I take "vorsorglich" to mean that the expert opinion had not been ordered by the court but was rather submitted voluntarily.
