Im Grunde geht es um den ganzen Satz, der aus einem Gerichtsprotokoll (Österreich) stammt. Die eine Partei verklagt die andere auf Schadensersatz, woraufhin die andere u.a. vorbringt, dass eigentlich sie Schadensersatz erhalten sollte. In diesem Kontext kommt der Satz:

"Es werde festgehalten, dass dem Rückforderungsanspruch an die hier beklagte Partei abgetreten worden sei."

Eine furchtbare Konstruktion mit dem Passiv, und ich verstehe auch nicht ganz, warum es "dem" und nicht "der" heißt. Vielleicht einfach ein Tippfehler? Bis jetzt habe ich nur:

"For the protocol, the repayment claim (???) has been ??? (transferred/assigned/surrendered) to the defendant."

Explanation:
Immediately came to my mind, because that is what is in our UK contracts. In the sense of restitution of paid licence & services fees in case of liability claims. Confirmed by Zahn (but I do not have a legal dictionary at home...). A tad more hits than "recovery claim" in Google, but that should be negligible.
