continuing damages Explanation: "weiterfressen" sort of means "continuing to eat their way through". In houses, this could for instance the advantage from a fungus, or also water damages, where the original damage can spread through walls and cause subsequent/additional damages. This does sound a little bit like your "consequential damages" and is indeed similar. However, has been unable to come up with a different and better term. HTH |

see definition below Explanation: from Dietl/Lorenz Weiterfresserschaden (Schaden, der durch einen fehlerhaften Teil an einer im übrigen fehlerfreien Kaufsache entstanden ist) (ProdHR) damage which has spread (literally, eaten its way to) the defect-free portion of purchased property from a defective part Durch die Trennung des fehlerhaften von einem fehlerfreien Teil der Kaufsache wird die Anwendung des Deliktsrechts (mit einer 3jährigen Verjährungsfrist) eröffnet Separating the defective part from the initially defect free remainder of the purchased item permits application of the tort law (with a 3-year statute of limitations) as opposed to contract warranty law (with a 6-month statute of limitations) The dictionary doesn't really provide a term for this in English. In lieu of a more "legalese" term, I'd suggest something like "spreading damage," but will check in my West's Law Dictionaries in an hour or so, and report back if I find something better. HTH! |
