The concept of a medicinal product
In its judgment, the Court recalled that the Community code relating to medicinal products for human use constitutes only the first stage of harmonisation, and that, in those circumstances, it is difficult to avoid the existence of differences in the classification of products between Member States. Definition in Article 1(2) of Directive 2001/83/EC allows a substance or combination of substances to become a medicinal product in two ways:
(1) by presentation
when the substance/s is presented as having properties for treating or preventing disease in human beings;
or
(2) by function
when the substance/s may be used in or administered with a view to restoring, correcting or modifying physical functions by exerting a pharmacological immunological or metabolic action, or to making a medical diagnosis.
