Nach dieser Auffassung liegt eine Verletzung des von Ihrer Mandantin nicht vor. Ich verweise insofern auf das deutsche Gebrauchsmuster XYZ, welches den Gegenstand des von Ihrer Mandantin Gebrauchsmuster-Schutzanspruch 1 weitestgehend vorweg nimmt. Genau in diesem einzigen, gegenüber dem vorbekannten Stand der Technik neu verbleibenden Merkmal des geltend gemachten Gebrauchsmuster unterscheidet sich allerdings auch der Gegenstand unserer Mandantin, so dass von einer Schutzrechtsverletzung keine Rede sein kann. Unterschiedlich bleibt allenfalls das Merkmal, daß der Gebrauchsmuster geschützte Sondenfuß Ihrer Mandantin zylindrisch ausgestaltet sein soll. |

In other words, all the other distinctive features have been argued into nirvana. By the way; it should read "gebrauchsmustergeschützt" not "Gebrauchsmuster geschützt". Regards.
