Da der Anspruch 1 nicht patentfähig ist und aufgrund der Antragsbindung über den Antrag nur insgesamt entschieden werden kann (BGH lnformationsvermittlungsverfahren II (GRUR 2007, 862) und BGH elektrisches Speicherheizgerät (GRUR 1997, 120, 122)), sind auch die Patentansprüche 2 bis 29 nicht gewährbar.

Im BPATG Jahresbericht 2008 wird Antragsbindung in der Zusammenfassung in Englisch umschrieben. Ich finde, dass diese Lösung im vorliegenden Fall auch passt.

Seite 38: "Die Frage der Bindung an den Antrag des Einsprechenden wird im Bundespatentgericht nach wie vor
kontrovers diskutiert."

Seite 141: "The question of the binding nature of the application of the opposing party is still the subject of
controversy in the Federal Patent Court."

Ein weiteres Beispiel auf Seite 43: "Im Patentnichtigkeitsverfahren ist unter Berücksichtigung des Dispositionsrechts des Patentinhabers und des Grundsatzes der Antragsbindung das Streitpatent..."

mit der englischen Entsprechung auf Seite 144: "In the patent nullity proceedings, taking accountof the right of disposition of the patent owner and of the principle of the binding nature, the disputed patent..."
