Auch wenn nich bekannt ist, ob das Produktdatenblatt xxx dem Kunden übergeben und so oder auf ander Weisen öffentlich zugänglich wurde, kann die Kammer doch die dortigen Angaben als Nchweis der Eigenschaften dessn, was geliefert, bzw. *vorbenutzt* wurde, heranziehen.
I have seen a translation of "prior use" for the noun, but however the above is translated I would appreciate any comment on what it means when products are "vorbenutzt", or examples, perhaps. TIA |

Vorbenutzung - die Benutzung einer Erfindung vor ihrer Anmeldung zum Patent. Eine der Öffentlichkeit zugänglich gemachte Vorbenutzung im Inland ist »neuheitsschädlich«, steht also einer Patenterteilung entgegen. War die Vorbenutzung nicht öffentlich zugänglich (offenkundig) und kommt es zur Patenterteilung an einen Dritten, so tritt der Patentschutz gegenüber dem redlichen Vorbenutzer nicht ein; dieser bleibt befugt, die Erfindung für die Bedürfnisse des eigenen Betriebs weiterzubenutzen (§ 12 Patentgesetz).
