Nachdem die T. Papierfabrik AG sämtliche Ansprüche, die ihr aus dem mit den Beklagten geschlossenen Kaufvertrag vom 31. März 1993 zustehen, an die Klägerin abgetreten hat, macht diese einen Teilbetrag von 100.000 DM als Schadensersatz wegen nicht vertragsgemäßer Lieferung der Mahlgarnitur geltend. Die Beklagten sind dem Klagebegehren unter anderem mit der Begründung entgegengetreten, sowohl die T. Papierfabrik AG wie auch die Klägerin seien ihrer Untersuchungs- und Rügeobliegenheit nicht rechtzeitig nachgekommen; die Mängelanzeige der T. Papierfabrik AG gegenüber den Beklagten sei verspätet erfolgt.

Asker: Thanks Kim, I think I had a blackout with my clients spelling, orphography. They keep typing in an O where they cannot use an ü.Your explanations are as good as ever and I am now sitting here feeling very stupid.
