From an essay on ecclesiastical and secular theories of the state after the French revolution.

Görres dagegen verweist gerade auf die Vitalität des Volkes, das er wie alle Romantiker als *rechtsschöpferische* Quelle ansieht. Ein widersprüchlicher Zug des romantischen Denkens kommt allerdings darin zum Ausdruck, dass die Organismusidee, die dynamische bzw. dialektische Kraft der Gegensatzeinheit von einem Positivismus flankiert wird; denn die bestehende monarchische Verfassung wird andererseits als stabile historische und gottgewollte Gegebenheit aufgefasst, die selbst von den *rechtsschöpferischen* Kräften des Volkes und seiner ständischen Körperschaften letztlich unberührt bleibt.

So far I have "source of law" for the first instance and "constitutive" for the second, but am really not sure.

But I'm not sure how I'd tackle the term in the second sentence
rechtsschöpferische Kräften des Volkes – the creative ... forces of the people

Fehlt eine einschlägige Norm, die den zu beurteilenden Interessenkonflikt entscheidet, ist der Richter aufgefordert, rechtsschöpferisch tätig zu werden. Er muss seine Entscheidung danach ausrichten, wie das Gesetz die gegenüberstehenden Interessen in ähnlichen Fällen gegeneinander abgewogen hat. Vom Richter ist also nicht buchstabengenauer Gehorsam gegenüber dem Gesetz, sondern "interessengemäßer" Gehorsam gefordert.

Academic arguments, from the jurisprudence of decisions to "creative" jurisprudence and from creative jurisprudence to an action-oriented jurisprudence were of little help. Neither was the spirit of the times such as to encourage talk of the "art of law" as well as of the "science of law", and certainly not, to paraphrase a famous advertisement slogan for a bank, of the "fine art of lawyering".

Explanation:
Shouldn't the word have only one "s"?
My first thought was "the original source of laws", "the original legislative source". I then searched for the word in Dietl Lorenz, found "Rechtschoepfung" as "law-making", which I'm sure you can also use as an adjective here.
I wouldn't suggest using "constitutive" in this case. For the second example, maybe something along the lines of "the power of the people to draft laws / legislature"

Hope this is a step further in your search.
