Neither was the spirit of the times such as to encourage talk of the "art of law" as well as of the "science of law", and certainly not, to paraphrase a famous advertisement slogan for a bank, of the "fine art of lawyering".

I should add that the second sentence has a footnote referring to Carl Schmitt's Politische Romantik, although I haven't found any evidence that the term rechtsschöpferisch is from him.

Explanation: Shouldn't the word have only one "s"?
My first thought was "the original source of laws", "the original legislative source". I then searched for the word in Dietl Lorenz, found "Rechtschoepfung" as "law-making", which I'm sure you can also use as an adjective here.
I wouldn't suggest using "constitutive" in this case. For the second example, maybe something along the lines of "the power of the people to draft laws / legislature"
