Der Umstand, dass sich eine Partei im Falle der Vertragsverletzung nicht beruft... kann in keinem Fall als Einverständnis usw.

Anyone with the proper term for Anzeigeverzicht...

Explanation:
There is really not much to go on here, but the limited context makes me believe that the person either simply didn't get around to objecting, but he may in fact have waived a right to do so.
It is not just a matter of a notification IMO

Of course, we may not be dealing with an actual situation, but merely a clause in a contract which states that such failure or waiver does not constitute an agreement of a violation, or does not condone the violation
