1. Qualifiziertes Verschulden i.S.v. Art. 29 CMR ist gegeben, wenn der Fahrer den mit wertvollem Transportgut beladenen Lkw ohne betriebliche Notwendigkeit über Nacht in einem Wohngebiet von Lissabon abstellt.

Könnte man es im Sinne einer "qualifizierten Straftat" (= aggravated offence) als "aggravated fault" übersetzen?

agree  Steffen Walter: Ja, gut möglich - Art. 29 (1) erwähnt ja auch "or by such default on his part as, in accordance with the law of the court or tribunal seised [sic!] of the case, is considered as equivalent to wilful misconduct.".
