Wesentlich strafmildernd wirkt sich das Vorliegen des vertypten Milderungsgrundes gemäß § 23 Abs. 2 StGB aus; dies gilt auch, wenn sich in der Hauptverhandlung tatsächlich herausstellen sollt, dass die Tat deswegen im Versuchstadium steckengeblieben ist, weil der Zeuge XXX die weitere Tatausführung gehindert hat. Das Erfolgsunrecht wäre im übrigen auch deswegen gering, weil der angestrebte Schaden nur unerheblich ist.
