Ovvero, se ho ben capito, nel caso in cui la questione/controversia sia giunta a un punto tale per cui al giudice e' possibile emettere la sentenza.

secondo me la causa è matura per la decisione prima del deposito delle conclusionali. Dopo il giudice trattiene la causa in decisione perchè questa è entscheidungsreif e lui/il collegio deve emettere la sentenza. Secondo il commentario al paragrafo 300 ZPO una causa è entscheidungsreif, wenn der Rechtsstreit nach voelliger Aufklaerung des Sachverhalts und Erschoepfung der Beweise oder nach Abschneiden weiteren Vorbringens der Klage stattzugeben oder sie abzuweisen ist. Per cui direi che equivale al punto dove in Italia si parla di trattenere la causa in decisione |
