Es ist zuerst nicht ohne weiteres feststellbar, dass die auf einen einzigen Blatt kopierten Belege zueinander gehören, d.h. es steht nicht fest, dass es sich hier um Teile eines einzigen Dokumentes handelt. Demnach steht auch nicht fest, dass die Uberweisung an Frau.........tatsächlich von der Agenzia.........betätigt wurde.
Zweitens ist nirgends ersichtlich, dass die Uberweisung vom Beklagten 1 veranlasst wurde. Die Checkmitteilung gibt keine Auskunft über die Herkunft des Geldes.
