Rechtsfehlerhaft ist auch die Annahme des Landgerichts, die Klägerin hätte bereits im Vorfeld der Kündigung eine Geschäftsbeziehung zur Firma YYY aufgebaut. Es handelt sich hierbei um ** streitigen Sachvortrag **, den das Landgericht nicht ohne Beweisaufnahme hätte zugrundelegen dürfen.

Keineswegs kann davon die Rede sein, dass die Klägerin sich durch die Aufnahme der Geschäftsverbindung mit YYY "abgesichert" hat.

Asker: Ciao e grazie mille per la risposta :) Era il contesto, oltre a "streitigen", a farmi venire dei dubbi. Da questa conferma devo dedurre che "Annahme des Landgerichts" significhi, più o meno, "il fatto che il Tribunale regionale abbia accettato (la versione secondo cui la parte attrice avrebbe avviato già prima della risoluzione un rapporto commerciale con la ditta YYY ecc.)"
