Non è tanto il termine in sé, quanto la frase che sembra non tornare. Si parla di un prestito non accettato dal "debitore principale", un prestito il cui importo (?) era cambiato per via del comportamento della parte attrice e del debitore summenzionato (???):

Insoweit ist der vorliegende Sachverhalt nicht mit dem Sachverhalt zu vergleichen, über den der BGH in dem von der Beklagten zitierten Urteil zu entscheiden hatte. Die Ausführungen im angefochtenen Grundurteil, das der BGH hier adressierte, betreffen die Haftung des Bürgen fiir einen Schaden, der dadurch entstand, dass die Hauptschuldnerin ein vereinbartes Darlehen nicht abgenommen hatte. Dessen ** Höhe ** hatte sich durch das Verhalten der Klägerin und der Hauptschuldnerin verändert.

Nach alledem ist die Berufung zulässig und in der Sache begründet.
