...Aufgrund des wirksamen Rücktritts wurde der Vertrag in ein Abwicklungsverhältnis umgestaltet, bei dem die empfangenen Leistungen Zug um Zug zurückzugewähren sind, §§ 346 I, 348 BGB. Die Beklagte ist daher verpflichtet, der Klägerin die empfangene Anzahlung zurückzuzahlen.
Der von der Beklagte selbst erklärte Rücktritt hatte wegen des vorherigen wirksamen Rücktritts der Klägering und der daraufhin erfolgten Umwandlung des Vertrags in ein Rückabwicklungsschuldverhältnis keine eigene Bedeutung mehr.
....Da der Vertrag aufgrund Rücktritts der Klägerin rückabzuwickeln ist, ist die Klägerin zur Erfüllung dieses Vertrags nicht mehr verpflichtet. |
