In einem gerichtlichen Beschluss wird darauf hingewiesen, dass noch nicht feststeht, ob in einer Klage wegen Zahlung des Frachtlohns deutsches Recht anwendbar ist.

Diesen Satz habe ich zu übersetzen:
"Bei Anwendung des Art. 23 EuGVO wäre eine entsprechende Schriftform oder sogenannte Halbschriftlichkeit nachzuweisen".

1. Eine Gerichtsstandsvereinbarung gem. Art. 23 Abs. 1 EuGVVO im Wege der sog. „Halbschriftlichkeit“ setzt neben der schriftlichen Bestätigung einer Seite eine vorausgehende mündliche Vereinbarung voraus.

Es handelt sich also um eine mündliche Vereinbarung mit schriftlicher Bestätigung einer der beiden Seiten.

Weiß jemand von Euch ob es einen italienischen Fachbegriff für die Halbschriftlichkeit gibt?

Ansonsten würde ich tendieren zu : accordo orale con conferma scritta di una delle parti
