" Dem Vermerk "per Saldo" oder "per Saldo aller Ansprüche" wird in der Lehre und Rechtsprechung verschiedene Bedeutung beigemessen. Zum Teil wird angenommen, dass mit dieser Formulierung ein durchschnittlich gebildeter Arbeitnehmer auf alle bestehenden, d.h. sowohl auf ihm bekannte als auch auf unbekannte Ansprüche verzichten will, sofern nicht besondere Umstände dagegen sprechen. Nach BGE 100 II 42 ist aber ein Verzicht nur auf bekannte Rechte und auf solche zulässig, deren Entstehung man als möglich betrachtet. Daher wird die Saldoklausel bloss als Verzicht auf solche Ansprüche verstanden, die der Arbeitnehmer konkret als möglich erachtet hat (Rehbinder, Art. 341 OR N 10 S. 262 mit Hinweisen)."
