Die Kaufmannseigenschaft ist im HGB geregelt. Ein Nichtkaufmann ist nicht buchführungspflichtig (Bilanzen etc.). Er kann beim Finanzamt auch nur eine Einnahmen-Ausgabenrechnung einreichen. Genau darauf wird sich der Kurs beziehen.

Dabei ist unerheblich, ob er Waren einkauft!
