Utilize, neste caso, um termo mais geral. Nunca vi em textos contratuais o termo "falta de comparência ou comparecimento". Esta colocação não é adequada, creio. Seria uma tradução muito literal, apenas cabendo em contextos referentes a "Nichtantritt der Reise", por ex.
Por isso sugiro algo mais geral, como cancelamento, pois neste caso é o que o Nichtantritt quer dizer.
Outra opção seria "descumprimento" do contrato, pois o Nichtantritt é uma forma de descumprimento do contrato, e por consequinte, as partes terão que fazer o cálculo com base na experiência anterior.
