Plecand de la premisa ca termenul de "Konventionalstrafe" se refera in documentul tau la o clauza contractuala (penala) intre parti, asa cum este si definitia sa - "Die Vertrags- oder Konventionalstrafe wird zwischen zwei Vertragsparteien für den Fall vereinbart, daß eine Partei die geschuldete Leistung nicht wie vereinbart erbringt (§§ 339 - 345 BGB)" -, nu cred ca termenul de "amenda" s-ar potrivi, intrucat, cf. aceluias Cod civil german (BGB), exista si alte sanctiuni decat amenda in caz de nerespectari ale clauzelor contractuale de catre una dintre parti.
