Entsprechend den allgemeinen Abgrenzungskriterien ist ausschlaggebend, ob die Tagespflegeperson bei der Gestaltung und Durchführung der Kinderbetreuung an Weisungen der Eltern bezüglich Art, Ort und Zeit der Betreuung gebunden ist oder Art und Umfang der Betreuung selbst bestimmen kann. Dazu gehören z.B. Fragen der Ernährung der Kinder ebenso wie die konkrete Ausgestaltung der Betreuung (Fernsehen, Spiele, Ausflüge)
