No entiendo la siguiente frase. "erhält", ¿significa aquí simplemente recibir? Si la empresa es la que le vende el objeto de suministro al cliente, ¿cómo es que habla de recibirlo? Die Firma ist berechtigt, vom Vertrag zurückzutreten, soweit sie trotz des vorherigen Abschlusses eines entsprechenden Einkaufsvertrages ihrerseits den Liefergegenstand nicht erhält; die Verantwortlichkeit der Firma X für Vorsatz oder Fahrlässigkeit bleibt nach Maßgabe von Ziff. 5 Abs. 3 unberührt.

Explanation:
entiendo que la empresa puede retirarse del contrato, si no le suministran el bien, a pesar de haber suscrito el contrato de compra. Asi tampoco no puede venderlo al cliente.
