B. Types of Actions
Several criteria are used in order to classify the various types of actions. The classical categories of complaints were developed in Roman law and rely heavily upon substantive law concepts (e.g., actio in rem, actio in personam, actio mixta; further examples on similar lines of thinking would be the hereditary action or the family law action). More important, however, is *the procedural classification based on the type of relief requested by the plaintiff*. In this respect, a tripartite division emerges: actions for performance, actions for declaratory judgment, actions for judicial modification of legal relationships.
The *action for performance* (καταψηφιστική αγωγή) is the most ancient and remains today the most usual type of action. It aims at a judgment ordering the defendant to perform as obligated; the performance may be a specific one, or consist in the payment of money. Article 69 of the Code of Civil Procedure rather broadly allows even an action for future performance, thus turning an originally repressive remedy into a preventive one. *The practical relevance of an action for performance lies in the field of enforcement: it is the only type of action which, if successful, opens the way for enforcement by execution*. By contrast, declaratory judgments are not, strictly speaking, enforceable. They make a binding determination of a legal relationship capable of becoming res judicata. Therefore, *an action for declaratory judgment* (αναγνωριστική αγωγή; art. 70) (1) must concern a specific legal relationship, and (2) requires a legal interest on plaintiff's part especially worthy of protection. There is increasing recourse to such actions in Greece, since their litigation is exempted from the fee levied by the state on the trial of an action for performance. Finally, an action for judicial modification of legal relationships (διαπλαστική αγωγή; art. 71) is available only in cases provided for by law, for example to obtain a divorce or to set aside a contract on account of fraud, threat or mistake. Greek law does not permit the courts to alter existing legal relationships between the parties without an express statutory authorization which is granted only in exceptional cases.

Yes, you must pay costs and charges. You must pay the fiscal stamp duty (hartosimo), the court stamp duty (dikastiko ensimo) in the case of a contentious action and charges for various funds (e.g. the Legal Servants' Fund (Tamio Nomikon, T.N.) and the Athens Lawyers' Welfare Fund (Tamio Pronias Dikigoron Athinon, T.P.D.A.) which are paid when the case is brought.
