Απαντώ εδώ στις αντιρρήσεις της Ελένης:
Το "voluntary jurisdiction" είναι ένας παλαιότατος όρος που χρησιμοποιείται σε πολλές χώρες και τον καταλαβαίνουν όλοι.
Το "non-contentious" είναι πιο πρόσφατος όρος, που συντάσσεται άριστα με το proceedings και είναι απόλυτα κατανοητό στους Αγγλοσάξονες ως non-contentious proceedings αλλά δεν προσφέρεται για πολλούς άλλους συνδυασμούς και το "non-contentious jurisdiction" θα ήταν εντελώς περίεργο για τους Αγγλους.

Όσο για τον Κοζύρη στο Introduction to Greek Law, λέει τα εξής:

XI. NON-CONTENTIOUS PROCEEDINGS
A. Doctrinal Foundation
According to both article 93 III of the Constitution and article 1 lit. a of the Code of Civil Procedure, the jurisdiction of the ordinary civil courts includes not only the adjudication of disputes but also the regulation of the so-called *affairs of voluntary jurisdiction* (υποθέσεις εκουσίας δικαιοδοσίας) which are assigned to them by statute. A distinction is thus drawn between contentious or adversary (iurisdictio contentiosa) and non-contentious or voluntary or ex parte jurisdiction (iurisdictio voluntaria). The criterion is to be found in the nature of the subject matter of jurisdiction as well as in the function of the judicial decision on it. Disputes involve the violation of a substantive right as between at least two persons; they seek a decision evaluating the behavior of persons in the past, inferring therefrom the consequences provided for in the law. By contrast, non-contentious affairs do not refer to relationships between persons, but contemplate one person as an individual and his legal situation; they aspire to protect it through judicial measures taken not as a sanction for past deficiencies but in anticipation of future needs. Functionally, therefore, *voluntary jurisdiction* looks more similar to public administration than to proper civil justice. This tenuous relationship between non-contentious affairs and civil procedure explains why the former require a specific statute for them to be assigned to the jurisdiction of ordinary civil courts.
