A paramount watershed between the civil law and the common law however becomes clear if one looks at the existence of a general <em>penal law duty to rescue people in distress</em>. It is well-known that in most of the civil law-countries, such a general duty to come to the rescue of strangers is laid down in the national Penal Codes.
