| | Effective Cause | Explanation: The literary translation of this term, namely "Effective Cause", is widely used in english and since the source text merely mentions "גורם יעיל", I don't see any reason why one should alter or adapt it according to any context whatsoever.

Explanation: or (more wordy)...the party responsible for the sale (the effective cause)...
"There can be no question that the fiduciary duty of the seller has been completed. This is important when the seller is not the owner, but a party responsible for the sale of the property (Murdock, 2003).

To be honest, I'm not sure this is conveyed very well in English. The basic meaning is the person who brought about the sale of the property, the person who was the "effective cause" of the sale....
"I think on the facts of the case it was the introduction which was the effective cause of the sale, bringing together the two parties
who wanted a particular ship of that sort at that price, and that Mr
Allan's efforts were therefore the effective cause of the sale.."

(The context in this quote isn't real estate, but this is irrelevant here as they are only using this in a larger discussion on the topic).
The problem is that גורם יעיל can refer to any of the many English terms banded around: agent, broker, middleman. As any one of these (and others) can be the effective cause of the sale.
In your text, it appears to be referring to the realtor, therefore indicating that s/he is the effective cause of the sale.

sin·sti·gate/ˈinstiˌgāt/
Verb:
1.Bring about or initiate (an action or event): "instigating legal proceedings".
(This is why I think "instigator of the sale" is perhaps the better of my two options - the person who BRINGS ABOUT the sale(the event).

N.B Forgive the typo above..not "sinstigate", it's a pasting error. Apologies.
