סעיף 26 לחוק הירושה – תשכ"ה 1965 קובע כי צוואה שנעשתה ע"י קטין, מי שהוכרז פסול דין, דינה להתבטל. כמו כן, צוואה אשר נערכה בשעה שהמצווה לא היה מסוגל להבחין בטיבה – בטלה. חוק הכשרות המשפטית האפוטרופסות מגדיר פסול דין כמי שהוכרז ככזה על ידי בית המשפט בהתאם להוראות החוק. כמו כן, חסוי אינו בהכרח פסול דין.
