ˇ General rule is that the contents of a private document must be proved by primary evidence.

ˇ Primary evidence may be provided in the following forms:

- Production of the original document - when in the hands of an opponent must serve a subpoena duces tecum.

- Admissions

- Copies made under authority - words of a will.

ˇ Secondary evidence - usually a copy or oral evidence of its contents. It is admissible when :-

ˇ After due search original lost or destroyed.

ˇ Inconvenient to produce original in court (writing on a wall).

ˇ Original in hands of opponent who fails to produce it.

ˇ When original in hands of a third party, who after a subpoena duces tecum has been served has lawfully refused to produce it, e.g., on ground of privilege. Secondary evidence is not admissible, however, where he wrongfully refuses to produce it. The subpoena must be enforced.

ˇ Where the Banker’s Books Evidence Act 1979 applies."
