Adaptive leave is explained in decree number 11 of 1979 Provision on Punishment and Law Enforcement, 84/A. If
the forensic compulsory treatment began at least one year before, the patient is allowed to have “adaptive leave” by
the director’s permission. This maximum time for adaptive leave is 30 days, but it is possible to extend this time.
According to the IMEI Decree, there must be a designated person who agrees to care for the patient and this person
has to make a written statement to the court confirming that the patient can spend the adaptive leave at that person’s
home. The court must take into consideration the patient’s condition, the host’s social circumstances and the original
offence. During the adaptive leave the patient must see a doctor within the first 48 hours. Thereafter, the doctor
decides how often the patient has to be seen, but no less than every 2 weeks. IMEI retains medical control, but outside
Budapest the patient must go the local mental health clinic. IMEI identifies the doctor who will see the patient
and also informs the local police station. The mental health clinic must inform IMEI if the patient’s condition deteriorates.
